Terms & Conditions

These Terms and Conditions (T&C) apply to all orders placed with us by consumers and businesses through our online shop.

Please note: This is an English convenience translation. The binding version of our terms is the German original (AGB). The contract language is German.

§ 1 Provider & scope

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity that, when entering into the contract, is acting in the exercise of its trade, business or profession.

§ 2 Conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the order button, you submit a binding order for the goods contained in the shopping cart. Receipt of your order is confirmed by email immediately after it is sent. This confirmation of receipt does not yet constitute acceptance of the contractual offer. A purchase contract is concluded when we accept your order by means of an explicit order confirmation or by dispatching the goods.

We store the contract text; we send you the order data by email. The contract language is German.

§ 3 Prices & shipping costs

All prices are final prices and include the statutory value added tax, where this is shown. In addition to the prices stated, shipping costs may apply; these are clearly communicated to you before you place your order.

§ 4 Payment

The payment methods offered during the order process are available to you. Unless otherwise agreed, payment is due immediately upon conclusion of the contract.

§ 5 Delivery

We deliver to the delivery address you provide. Information on delivery times can be found in the respective product description or during the order process. As many of our pieces are made and engraved to order, processing times may vary – we will inform you of any delays.

§ 6 Retention of title

The goods remain our property until they have been paid for in full.

§ 7 Right of withdrawal & exclusion for personalised goods

Consumers have a statutory right of withdrawal. The details can be found in our withdrawal policy. You can conveniently declare your withdrawal via our online withdrawal form.

Important note: The right of withdrawal does not exist, or expires, for goods that are not prefabricated and for the manufacture of which an individual selection or specification by you is decisive, or which are clearly tailored to your personal needs (Section 312g (2) no. 1 BGB). This applies in particular to personalised engravings and engravings made to your specifications (e.g. with names, dates, custom texts, requested motifs or your own photos). Such one-off pieces are excluded from withdrawal and exchange.

In the event of an effective withdrawal, you will bear the direct cost of returning the goods.

§ 8 Warranty / liability for defects

Statutory warranty law applies. Natural materials such as slate, wood or antler naturally show differences in grain, colour, structure and shape. Such natural variations are not defects but characteristics of the material. If you have a legitimate complaint, simply get in touch at info@glanzundgravur.de – we'll find a fair solution.

§ 9 Liability

We are liable in accordance with the statutory provisions for damage arising from injury to life, body or health, as well as for damage arising from the breach of essential contractual obligations and in the case of intent or gross negligence. Otherwise, liability is excluded to the extent permitted by law. In the case of slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract.

§ 10 Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. You will find our email address above and in the imprint. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence. Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected.
